The thing about the Garam case

  • Why would her accusers still be trying to smear her with things like that document if they know they're gonna probably get sued or into some legal trouble? Why are they trying so hard despite all the circumstances? Faking documents is a very serious crime in South Korea so they should know that doing so would get them in worse shit than being sued. They can't be that stupid. Right?


    I'm not saying she's 100% guilty or not guilty. I'm willing to look at both sides. Maybe they are stupid? Perhaps they're trying this hard to slander Garam's name? I don't know. But I can't just ignore the possibility of it being all true. Other idols have gone on hiatus or left because of much less evidence. I'm also trying to create some civil discussion on the issue.

    They need to be found first. If the accuser(s) are smart enough about it, they can do their stuff hidden behind vpns and such with next to no risks. It's not like Interpol is gonna investigate the case anyway.


    Or they are indeed stupid, then so what? Is it so outlandish? It's most likely teenagers we're talking about.

  • I dont think the suing argument holds water. You dont need to give your real info anymore to post on the forums, even as a Knetz. You can make it extremely difficult for a company to track you, so Hybe would have to somehow convince the Korean FBI to get involved to nail down a truly determined troll.

    Since when you don't need to give real info anymore? To create an account in those forums you need a verified Korean phone number and some sites even ask for government issued ID especially some gender segregated ones which even ask you for proof of your gender

    Someone posted that Korean government repealed the laws requiring all these verifications.


    The important question is...what are the ID requirements for the forum that the accuser used to upload the "proof"?


    Secondly, assuming that you have to give your real personal information to create an account in that forum, how does Hybe go about getting that information? Can Hybe force the forum owners to give up the info?


    I've always wondered about how these Korean libel laws are enforced. In the US, it is almost unheard of to win a slander/libel lawsuit if you're a celebrity and trying to sue rando Joe Q Public for posts on a forum.

  • HYBE could try to personally exercise their influence with the site owners the get it voluntary of course, but generally in cases like this, the normal way would be getting a court to order the site owners to give the account's personal IP, all posts made by the user any information they may have like phone numbers, address etc


    In the US, generally you don't sue random internet people for defamation but SK libel laws are stronger. What you do see in the US is judges ordering sites to hand over user personal information when things like school shootings and other crimes happen and the person responsible posts in forums, 4chan, Reddit etc

    Also if it's IPV6 they can get the MAC address of the actual physical device.


    They can also intercept and track the TCP traffic.

    If it's UDP or a VPN they can ask the internet service provider for matching tokens.


    It's actually very easy to track somebody on the internet.

  • What I'm wondering is, if this document is real and belongs to the school, who leaked it? One of the school staff? How did the students get hold of it? Also, if it's real, why is the document cropped like this instead of being sent in full? No school name, no stamp, no signature. Weird.
