FIFTY FIFTY might lose against their ex Ceo

  • According to the report, Interpark, which had signed an advance payment contract with Star Crew ENT, expressed that "the investment contract does not involve the FIFTY FIFTY members, and the members have no obligation to repay any debts."

In a previous court hearing on the injunction application to suspend the exclusive contract's validity, held at Seoul's Central District Court in Seocho-gu on July 5, ATTRAKT CEO Jun Hong Joon raised eyebrows. The CEO had signed a contract advancing a payment of 9 billion KRW from Interpark Music to Star Crew ENT, a private company, sparking curiosity.

The legal representative asserted that 6 billion KRW out of the 9 billion KRW total was invested in FIFTY FIFTY's album production, with the revenue from the music directed to Star Crew ENT. The lawyer added, "The contract was mistakenly made with the wrong company. It should have been with Star Crew ENT. They should bear the debt, not FIFTY FIFTY."

However, industry insiders have dismissed this argument as a common misconception among those unfamiliar with the intricacies of the advance investment contract process within the entertainment sector.

An official from Interpark Music clarified, "The rationale for the advance payment contract stemmed from Ha Sung Woon's success, a member of Star Crew ENT, and the experience, capability, and driving force provided by CEO Jun Hong Joon." At the time, FIFTY FIFTY had not yet established its team name, and Ahn Sung Il, CEO of The Givers, had not joined the project.

In short, advance contracts for sound recordings serve as a financial strategy often utilized by small to medium-sized agencies to offset production costs. The advance payment is allocated for the creation of the artist's records and to support the company's operating expenses, thus bearing no direct relation to the artist's settlement.

The official further clarified, "I understand that a portion of the 9 billion KRW invested in Star Crew ENT was used for FIFTY FIFTY. However, the entire amount is not solely for FIFTY FIFTY. It is an investment for Ha Sung Woon and other artists, and the transfer from ATTRAKT has been put on hold."

According to Interpark Music officials, the argument made by the members that "they had to sign an advance contract with ATTRAKT" is incorrect. Additionally, an official pointed out, "The members claimed that from December of last year to April of this year, they earned no revenue from music and albums. However, since their release 'Cupid' gained significant attention overseas, it is difficult to settle the accounts immediately, apart from the advance payment."

FIFTY FIFTY made their debut in November of last year and gained global popularity. They were initially celebrated as the 'miracle group of small-mid-sized company' However, the conflict has intensified, leading the members to file a lawsuit against their agency.

  • Putting the media play pulled by the Ceo aside it seems that Fifty fifty doesn't have a strong case against him, whoever pushed the girls to file for a contract nullification is pure evil, seriously it's really sad to see that group was never able to capitalize on Cupid success they could've been the next big thing but here we are

it was the other dude wasnt it? the one who copy righted cupid?

He sounds very slimy from everything

Even if their Current CEO is bad, idk how did they think the other dude is better

Even if their Current CEO is bad, idk how did they think the other dude is better

Well nothing has been said about him pushing the girls out of the agency all we know is that their ex Ceo accused Warner korea for trying to poach the girls through the givers CEO but Warner refuted those claims then the givers CEO counter suited Attrakt so far the girls didn't side with anyone expect themselves

  • Even if their Current CEO is bad, idk how did they think the other dude is better

Because thats the only dude they dealt with. From the sounds of it JHJ dropped money for them and left every aspect of the management to the Givers. It's easy to make Attrakt into a bogeyman to scare them into toeing the line and doing work when they aren't fit.

'Hate something? blame JHJ he's making me force you guys to do this, he's pushing you to go back to work, he's the reason everything has gone wrong and look how good we are at looking after you, we'd take much better care of you. etc.' - especially when they are so young and their families presumably have no experience in the industry. The members were nugu and barely did any idol work so they didn't even have time to make many idol friends and get the lo-down on these kinds of things.....

The members parents might have a role in this situation too, they might have gotten a big head with some bad advice from them

  • What's amazing and a bit confusing here is there are no collapse on their side, assuming The Givers are the instigators, you would think, like at the very least if the parents were purely driven by greed, they would have begun turning against The Givers or each other to save their own selves by now, but nope the unity is amazing tbh, the fact that they trademarked their names suggest they even have a long term view on this. lol

  • This is not as bad as it sounds to be

It shows Jeon blew up $6 million with nothing to show for it, proving the members' argument that Jeon is an incompetent person to lead them.

It also shoots down the Attrakt lawyer's claim that it spent a lot of money on Tiktok virals, etc.

This is a classic catch 22 = if Jeon admits on one thing he has to admit that he lied on the other thing.

As the owner's arsenal of media play begins to run out, he will have to back his wild claims with real documents which he seems to be lacking. Let's face it. Asking some nugus who are barely known to the public to support his cause was, I have to say, pretty pathetic; didn't he have other more famous names he used to work with?

Let's say Jeon does Fifty Fifty 2, and out of sympathy, IU, Karina, Haerin of New Jeans and Kazuha come to help Jeon for one project.

    Jeon will still fail it.

People liike Jeon have a knack to fail on the most auspicious project you can imagine, with the most bizarre and unbelievable reason possible. Some people are , I hate to say, just destined for failure.

  • Man, legal work is not for my tiny brain to handle. Can someone dumb this down for my uneducated brain.

What I understand is that the 9B won was 'mistakenly' made (signed?) with the wrong company? How do you mistakenly signed 9B won. You grab your keys instead of your umbrella, now that is a mistake.

9B won was an advancement used for other artists in Star Crew, does 50/50 know of this and was made clearly that they won't incurred the debt when they initially signed? The official said that 50/50 claim is incorrect, but they didn't say it was falsify. So there has to be something in between of what 50/50 understands vs what was being communicated to them. Or did the CEO be like "So, we got 9B won investment, want to sign contracts?", now that's luring. "SIKKEEE, 9B won aint for you!".

Bad news; 'maybe' 50/50 lost court case. Good news; no repay debt?

Media play aside, there are those that sides with the CEO- even a former girl group. However, there is also a singer Gil Hak Mi who sympathized with the girls. But seems like only the former girl group's statement are being taken into account for the public opinion and not the singer. Interesting.

    In any case :pepe-popcorn:

    ---======---

  • i'll never get your point in this case coz you are heavilly biased.
at least other user see it from both side and discuss it from there.

"It shows Jeon blew up $6 million with nothing to show for it, proving the members' argument that Jeon is an incompetent person to lead them"
is kinda wrong coz the promotion is not over yet.
and they're beginning to get jobs that could get them paid. but now its all halted.
    so we'll never know.

    excuse my bad english
basically what interpark said is . the claim fifty fifty said about the 9B investment for fifty fifty goes to CEO old company is incorrect.
coz it is actually intended for the CEO last company before FIFTY FIFTY’s team name established, and before The Givers’ Ahn Sung Il joined the production.
they invested in the old company coz of Ha Sung Woon.
there's a statement missing in this article.

"At the time, we made the investment due to Star Crew Ent’s artist Ha Sung Woon’s (Sungwoon) success as well as Jeon Hong Joon’s abilities. Interpark was aware that Star Crew Ent was planning on producing a girl group. At the time, FIFTY FIFTY’s team name hadn’t been established, and The Givers’ Ahn Sung Il had not joined the production.

We understand that some of the money we invested into Star Crew Ent was used for FIFTY FIFTY. As the group’s debut date came closer, Jeon Hong Joon made launched a new entity called ATTRAKT. We were considering transferring the investment to ATTRAKT, but we didn’t since the money wasn’t exclusively for FIFTY FIFTY. It was also for other artists, including Sungwoon."

about the debt they might still not in the clear. coz what interpark basically says is "they did not have to paid back the whole 9B investment to interpark coz it's not for fifty fifty to begin with but for the company itself"
plus their business is not with interpark but with attrakt.
fifty fifty does not equal the whole company.

  • Reading between the lines, Interpark's threading the needle here trying to remain on the side of JHJ since they're on the same boat in terms of interest, distancing themselves from any potential shortcuts JHJ might be taking with the members payment contract structure, and avoiding implicating themselves in any potential wrongdoing. They wanted to make it clear that their 9B advanced payment agreement (loan) was with Star Crew and not Attrakt and that they are not involved in the mess going on between Attract and Fifty Fifty members. Reminds me of China's dynamic with Russia when Ukraine was no longer a sure thing.

To quickly recap part of the lawsuit, the members were surprised to find out that they had a 6B settlement structure at Attract that they hadn't been informed of (and had no idea what the money was spent on, and if it was even all spent rather than tucked away somewhere) while any income they generated was going to Star Crew to fulfill obligations there that they also never agreed to (we'll leave for a later date the real problem which is that JHJ has to come up with new money if he wants to pay down the members' 6B structure at Attrakt since income is going to Star Crew). Their lawyer pointed out that were a proper structure to be agreed to and set up, it would be between Interpark and Attrakt instead.

This could possibly bring Interpark into question. Interpark responded with their first point they wanted to make - their agreement was with Star Crew and was never with Fifty Fifty (Attrakt). What's unsaid is that they want to be able to claim that they deal at arms length with JHJ's Star Crew, and any shenanigans at Star Crew or Attrakt is none of their business.

The second point they wanted to make clear was that Fifty Fifty doesn't have an obligation to repay the advanced payment debt. Well, technically this might be true, but who's generating the income to repay? Saying this protects themselves and shades the members - killing two birds with one stone. Brilliant, really.

As for JHJ, he had been clouding up the issue by saying that the members were still at Star Crew when the agreement was signed and that when they left Star Crew and signed on to Attrakt, somehow the payment structure also got transferred with the members' agreement. Again, this brings into question the legitimacy of Interpark's agreement. This is probably the reason why Interpark is even speaking to the media - because both the members' and JHJ's arguments in court implicated Interpark. Kinda begs the question why Interpark didn't sign the agreement with Attrakt in the first place.

Which brings us to the third thing Interpark wanted to do. They wanted to give a justification (really just for the public) for why they didn't sign the agreement with Attract. So this is what they came up with.

But Ha Sung Woon left Star Crew and signed with Big Planet Made (BPM) late 2021.

Ex-Wanna One member Ha Sung-woon signs with Big Planet Made
Former Wanna One member Ha Sung-woon has signed a record deal with new entertainment agency Big Planet Made (BPM).
    www.nme.com

So if Ha Sung Woon is gone and Fifty Fifty, effectively JHJ's only remaining artist, moved to Attrakt, why didn't they redo/transfer the agreement to Attrakt then? I have my theories, but it's speculative and ppl rooting for JHJ might pop a blood vessel so I'll end it here for now.

  • The rationale for the advance payment contract stemmed from Ha Sung Woon's success, a member of Star Crew ENT, and the experience, capability, and driving force provided by CEO Jun Hong Joon."

    what driving force lmao?

The hotshot members had to audition for several survival shows on their own with no company support even after they blew up and he did nothing to capitalize off it either.

Why would you invest millions for an artist who was already imminently leaving

Probably because interpark was the distributor for Sungwoons albums under starcrew

  • i feel so too, the ceo has too strong of a case

ig it was a case of being made to choose sides between their producer and ceo + members' greed after the success of cupid, welp i do see the members' losing this case, wont it be so awkward to still work in the company after that though or will they have to pay compensation??we'll see

Actually most of Jeon's case was built up on media play, fooling the general public who don't really care about the details. he will have trouble producing the documents which will actually matter.

The members will 'lose' the case, but that doesn't really matter since they will terminate the contract paying a little fee.
