This is a huge victory for them, and it could have BIG implications down the line...for others.

It also just got really awkward for the new 50/50, ATTRAKT and specifically Keena.

Things just got a little less boring

  • Interesting, I am shocked they sided with subcontractor. Theoretically, they're saying rights of a song belongs to the contractor rather than the company that contracted them due to them being heavily involved in the process. If that's the case that opens the door for a lot of groups. I assume other companies have more protected contracts than Attrakt

I assume this gets appealed, right?

I wonder about the forgery part, and if Keena retains any rights because she was originally credited. This whole case has always been confusing because if the contractor (The Giver) looked after everything, then shouldn't their grievance be with The Giver rather than Attrakt?

I think it just that IP and contract law is very very complicated and often requires very good lawyers, and even made more complicated because the relationship between Attrakt and The Givers are Contractor-Subtractor, so it's not like The Givers were just simple employees but they are a separate legal entity, it might just be a case of Attrakt writing a very poor contract. At best maybe companies are revisiting their own contracts. lol

  • This whole ordeal just continues to get messier in the most hilarious ways. Can they even perform the one song they the previous version of the group are known for now, without having to pay royalties each time? The only Kpop legal disaster that rivals the sheer scale of this one is NewJeans.

This is the final verdict. Givers and Siahn won. Period.

  • question as somebody who didn't rly pay much attention to the whole fifty-fifty deal:

so does that mean that the rebranded fifty-fifty can't sing that song or what? Or would only the girlies who left get to sing it? idk so im asking :)

They can sing that song without any strings attached. Song Jagyung only has rights for the rap part in the Koran version, which is irrelevant for Ablume.

  • This actually depends on the contract and it’s a popular topic.

MARZ (the producer who has made a lot of songs for SM and also yaps a lot) spoke about this sometime ago. SM basically makes the producer sign their songs over to the company for some fixed amount of money (usually not a lot) and Marz basically said he would never do that. And that’s why Marz and SM parted ways eventually.

I guess this is too small a company to have done something like that or carefully make the contract.

If you’re alluding to new jeans case in the end it’ll depend on the contract with HYBE/ador and I would not say there’s much to learn from this verdict without knowing what the original contract stipulates.

  • And my legend marz came back to sm just to work with exo again! He is a yapper but he is loyal!

And yeah, SM is notorious for underpaying their prodicers or never paying them at all...
