Since my question is being overshadowed in those related threads, is NJ officially free without going through the court? Since what I'm seeing on Twitter seems different

  • Before celebrating, I want to confirm this. They just need to fight for their IP rights, right? And now they already free without needing to pay termination fees or waiting for court decision? I saw many people on Twitter bashing them, saying they will now have huge debts and so on. Please help me understand.

    Her answer is still pretty vague tho. Do they think they don’t have to pay the fees but still need to go to court? Or are they actually free now, without needing an injunction like Loona had to go through?

  • Please correct me if I am wrong but the real battle will be over the New Jeans name and music. I can’t imagine the girls never being able to sing Ditto or Hype Boy. They have an amazing discography so who owns the rights to their music and can they perform it

    I'm curious about this because it's interesting that they announced their contract will definitely terminate at midnight. In other cases, like Loona and Omega X or even 50/50, they couldn't come to public like this and had to wait for an injunction and other legal steps before making a confirmation announcement that they're free from their company. They can't do it before that.

    From the sounds of it, if Ador fail to remedy the breach of contract, the members can terminate the contract. Ador can only claim the penalty if they can prove they did their duties properly.


    So essentially, they only have to go to court if Ador thinks they can prove they did their job and Newjeans owes them penalty fees for the termination. But if they fail to prove that, the court is likely to make Ador pay Newjeans legal fees and this would open them up to legal claims from Newjeans for breach of contract.


    Normally, groups stuggle proving the breach the company did, hence penalty fees and the legal mess. But this time, majority of this went down in public and included the leak of videos of minors, lack of protection of IP, the company being dragged by parliament no less and public documents detailing plans to replace said group and a lawsuit from one of the main collaborator companies with the group (Dolphiners). And thats just the publicly available stuff.

My guess is the majority of kpop contracts allow idols to 'seek' termination, i.e file an injunction, but if the leaked contract is real, Newjeans' directly gives them the right to terminate and the only point of contention is if they need to pay a penalty.

The only dispute will be about the termination fees if Ador challenge them (or they the one doing that) and their IP rights. This should be the new norm in every idol's contract. It's more humane and gives the artist more power over their contract, not only benefit the company.

    Honestly same, I kind of also wonder what to see what is in the average industry contract.

    I say, if they were smart, pay the termination fee and sue HYBE for it. This way they can at least make music why they sue and join a new label

    I don’t think you need to worry about that. They don’t need some random Bts stans from Akp that not even understand how laws works in Korea telling them what move is smart to take. They’ve got lawyers to advise and guide them. And every contract is different as the person above said, the girls surely know what’s in theirs and what their rights are.

    It's really not difficult to understand. Hybe and Ador are the once that need to file a lawsuit from Newjeans to stop them from acting independently.


    Basically, NewJeans terminate the contract with Ador without court intervention. Now Ador/Hybe have to proof to court that the contract termination is not valid and that they did everything to support NewJeans.


    Whoever NewJeans lawyers are deserve an A+ with handing this situation. NewJeans did everything per contract. The burden of proof now lies with Ador/Hybe. (It used to be the artist such JYJ, Loona, etc who needed to proof their companies violated their contracts)


    NewJeans can do what they want now until Hybe files an injection. Then NewJeans can countersues to continue to release music and contents without Hybe/Ador.


    I am sure NewJeans will create their own label (with MHJ?) and continue as 5 under a new name or NewJeans.


    NewJeans really did UNO REVERSE card on Ador/Hybe.
