I read somewhere that HYBE doesn’t have a penalty fee for contract termination. Is that right?

  • I forgot to save the tweet, and since it was in Korean, I couldn’t find it again. But from what I remember, it sounded like the members might have to give up their whole careers as NewJeans and start over from scratch if they want to left Hybe. I mean, it’s such a huge decision since there’s no guarantee they could come back with another successful career like NewJeans, especially with the group name already having such great commercial success. So, even though it's true, it's still hard to think that the girls will give up all of that just to get out of Hybe except they're really desperate and they see no other way out anymore. Yet, with how the NewJeans girls have been acting about after Mhj get fired, idk anymore. They’re not even hiding how uncomfortable they are with the new management anymore.


    Honestly, I’d actually feel a huge sense of relief if they left, even if they didn’t reach the same level of success outside of HYBE. I’d rather see them as a B-tier group in a place where they’re comfortable and with people they can trust their life and careers with. And even if they have to start over with a new name, I will keep supporting them. It won’t be easy, but it’s better for their mental health seeing how stressful this whole shitshow and how it affected them. I’d love to see them cut ties with MHJ too and start fresh somewhere else, but judging by the girls reactions, it seems like if they leave HYBE, they might just follow her wherever she ends up.

    In NewJeans’ case, according to Korea’s Fair Trade Commission’s standard exclusive management contract, the fees that one has to pay for a termination of contract is the sum of the average monthly sales for the previous two years, multiplied by the number of months remaining in the contract. They would also have to pay back the investments that they received. Although no one knows for certain how much money the company invested into NewJeans, an entertainment industry official claims that the average cost for a girl group is between ₩7.00 billion KRW (about $5.10 million USD) to ₩1.00 billion KRW (about $729,000 USD).


    NewJeans’ remaining contract period is said to be around 60 months. They also recovered all its investments thanks to their success, and were paid a salary after just two months of debut. This allows them to be exempt from paying back the investments, as is usually the case for other, less successful celebrities. NewJeans’ average monthly income has been estimated to be ₩3.50 billion KRW (about $2.55 million USD) during their debut era. Based off that, they would have to pay at least ₩210 billion KRW (about $153 million USD) in penalties. The amount is probably more, as their income has increased more than the original debut era income.

    Dang, how can there be almost USD$4.4m difference in an "average", someone is exaggerating or rather it could be the word "average" isn't the right translation because that sentence would make sense by removing it.

    As the Brand, Concept, Image and the Music released is controlled by the Company, the Artist part isn't compromised because Idol Content Creators (Producers/Composers/Lyricist etc) and the Artist's Talent has no restriction.


    Also, the rule only applies to those that want to prematurely terminate their Contracts to avoid a Fifty Fifty situation where the group wanted to take everything.


    I can imagine some Investor from China paying Stray Kids to leave while paying the Termination Fee and Penalties. Then renaming the group to "Wanderers" while keeping everything exactly the same :P
