While BTS brings in a lot of money, we don't know how much of it they actually got up until now, we only know they have some shares in big hit. We know the current value of those shares is quite high, but unless they liquidate those shares, those are assets, not cash. So BTS might have more in assets, but I think several second gen groups have more money they can easily access and are more reliable than company assets.
They could go to court and potentially win it, but it has to be either bts or anyone of bighit. Also it always takes a long time to do these things in Germany. I don’t know whether they would do that. It is also very costly.

I remember a lot of fights between SME fandoms, YG stans fought a lot with anyone who didn't think yg idols were the most talented and EXO-L had a period when they fought everyone. Therefore it's on the suer to demonstrate he purposefully established a racially based correlation between BTS (who happens to be Korean) and Covid-19 (which originates from China). It's not impossible to convince a jury with that but I wouldn't bet on it.
