my argument isn't that it's too 'harsh,' just that it's not an effective means to reduce crime. if you look at the statistical evidence, you can see that murder rates don't dwindle in societies that practice the death penalty.
They don't go up either, and even though that's not great that it's not going down, all the horrible people killing others die when they do so they never have a chance to do it again
