Wait, with MHJ’s non-compete clause, what will happen to NJ if they leave Hybe?

  • I’m really curious about what will happen with NJ now that they’ve threatened to terminate their contract. Some people speculate that MHJ might start her own company for them, but doesn’t she have a non-compete clause that prevents her from working in the entertainment industry in the next few years? Even if she tries to challenge that contract in court, it would still take a very long time to settle, especially considering how Hybe operates.


    If that’s the case, what will happen to the NJ members? Will they retire completely from the industry, or will they join an already established company? MHJ plays such a significant role in shaping their concept and identity, and I doubt smaller companies would be able to maintain that standard. It’s worrying to think about where they might end up.

    Sm is already out of the picture, and with Hybe holding shares in the company, I doubt Nj would move there while it’s still tied to Hybe. That said, I really hope they don’t end up under Mc Mong, a guy who pulled out his teeths just to dodge military service is just as shady as Hybe.

    MHJ got fired from Her CEO job so Hybe doesn't have an argument for non compete clause when you fire someone who is still suing in court.


    NewJeans is leaving Hybe as well since that letter stated they want MHJ as ADOR CEO. I read somewhere that MHJ family opened a company or something like that.


    Yeah NewJeans and MHJ are going to be opening a new company for sure. I also think this will be a battle in court but I can see Newjeans win this termination lawsuit against Hybe.

    What’s Bana? Anyway, I don’t think it will dissolve that easily. This doesn’t sound like something Hybe would do. I believe they included the clause from the start because they intended to fire her while also eliminating any potential future competition from her. There is no way they would just let her take Nj and start her own company, especially knowing the group poses a major threat to their own ggs. Hybe isn’t that 'kind', we all know it. That’s why I think Mhj were fighting for her position at Ador, it probably much easier than trying to dissolve the clause or she just genuinely didn't have any plan to leave Hybe since the start nor stealing Nj from them. Now, she’s probably finally seeking to terminate it through the court as Nj will in danger position if this going on longer.

    And Hybe was the one that made to dissolve the contract in it's entirety first, that's how they were able to fire her at all. Min HeeJin is simply agreeing to dissolve it, so that should speed it along

  • Ofc newjeans can leave, but what you need to worry is WHEN. Especially next year with BTS comeback from military, they will be at their full power. Hybe can just drag this case out until NJ's 7 years contract end and burry them until then, it don't matter MHJ leave or create new agency.

    They just need to win the injunction, which usually only takes a few months to get the results, and the girls can continue their careers. It’s kind of like how the loona members signed with a new company before their old contracts were officially terminated by the court.     Well if she's resigning just now it means that there was still a contractual relationship between both of them even after HYBE dissolved the shareholder contract.


    You can't resign from a job if there's no contractual relationship anymore.


    Usually when you have a high spot in a company, without being a shareholder, you might still have a non competition clause in your contract.


    Cuz it means that if you were at a high spot of the hierarchy you had access to the processus of production of the company, their marketing strategy and by leaving the company with all of this things in your hands

    You might bring the knowledge that this company took years to acquire to give it free to your new company and it might be consider as "parasitism"


    So non competition clause are often include even in non shareholder contract.


    So it's possible that she might had a contract as shareholder and another contract as salary of HYBE/ADOR

    I don't think you can just finish this case with few months, if it's possible NJ and MHJ already done that. The case was like what, april? we are at the end of the year and still 0 court case and BTS will comeback soon it will boost Hybe image.


    And hybe just can say "you can keep the penalty money for yourself, let's fulfill the 7 years contract. to the dungeon there you go". it's not like hybe don't like money, but they can recoup the money from BTS comeback and tour next year. But to bury top group that can hinder LSF, illit and your next GG?.


    You underestimate what Hybe can do with their money, power and connection.

    Actually if there's a clause in the contract which say " you can cancel the contract by paying a penalty of X amount"


    Hybe can't refuse to take the money even if they can get the amount of money NJ need to pay another way through BTS


    There's a proverb to make it very simple which say that a contract is like a law for people involve in the contract and they can't decided to change the contract in the middle without the approval of the both parts involve


    So hybe can't decide at the last minute that even if nj ask to pay, they can refuse the payment and keep them contractually involve with them until the end

  • Yes, I am, because laws are still laws. An injunction usually only takes months to maintain the status quo and prevent harm while a case is being decided. It’s always there to protect the less powerful party. What takes years is the actual contract termination. Even now, I believe some Loona members still haven't fully gotten out of their contract with Bbc. And Hybe can’t refuse Nj's termination fees if it’s stated in their contract that allows termination upon payment of a fee. From how Mhn talked about this before, and how Hybe has mediaplays using the amount of the fees to scare the Nj members, I guess that’s what’s written in their contract.


    I didn’t underestimate Hybe’s power as a corporate, but I’m talking about the law. They can try dragging it out, who’s to say they can’t, but there’s also proof that courts usually side with idols when the company is always the more powerful one. Idols are not views as an employees actually make it much easier for them in the court tbh.


    I also forgot to mention that MHJ and NJ’s actions right now are to avoid being seen as traitors like 50/50, so Hybe doesn’t gain the upper hand. That’s why it’s taking them longer to decide on terminating their contracts. Now, they have chance to leave without paying a cent.

  • You need to sign a contract to be held to it.


    MHJ maintained her previous position as a director but had no real role or responsibility because they were still hammering out the details on a Producer contract. That contract would have had a non compete of a year that she loudly protested against and refused to sign, so it's reasonable to assume she doesn't have one at all anymore.
