HWANG HANA = 20 Months Prison Punishment (NO Probation) ; 2021.11.15

HWANG HANA (Age 33), the wealthy socialite (only) grand daughter of Namyang Dairy's founder (large firm), who was put on Court Trial for taking illegal drugs (LSD), was sentenced to 20 Months Prison duration by the Appeals Court (Final).

The Seoul Western District Court's Criminal Affairs Department 1-1 (The senior Judge Sung Ji-ho) on this November 15th, sentenced HWANG HANA to One Year plus Eight Months in prison, and $425 USD in fines (property theft), for violating the Law on Drug Management (illegal drugs usage).

The Appeals Court found HWANG HANA, who was found guilty in her original Court Trial, (again) guilty of taking some methamphetamine (LSD = illegal drugs). Regarding the alleged theft, (Judge) he said --> "The (theft) victim made detailed statements about how he specified the defendant as the suspect (HWANG HANA), to the investigative agency (Police) in the original Court Trial" ... (So, Judge) Adding that she is found guilty.

The Appeals Court ruled that the defendant (HWANG HANA) used illegal drugs (LSD) with her acquaintances and stole goods from them.

The Judge said --> "Drug crimes are at high risk of repeat offenses and social harm ... In particular, the defendant committed crimes during her Court Probation Period ... At the time of the suspended sentence (Probation , NO Prison , Year 2019 illegal drugs usage events), the defendant (HWANG HANA) and the defendant's father submitted documents to the Court saying she would stop taking (illegal) drugs. Which became an important reason for the suspended sentence (No Prison at that time)."

The Judge added --> "(HWANG HANA) She did not show any remorse in the original Court Trial (even though she had committed the same LSD illegal drugs crime again) and tried to pass responsibility on to others (namely, her now suicide dead husband on 2020.12.24, Mr. OH) ... The crime is grave. Furthermore, even though the defendant was not in an economically difficult situation, she committed the crime of stealing the victim's goods (property). And she denies the crime. Severe punishment is inevitable."

The Judge ruled --> "However, (final) consideration was given to the fact that (HWANG HANA, at this Appeals Court event) she (has now) admitted to taking some methamphetamine pills (illegal LSD). But she denied theft (of property), and reached agreement with the (theft) victim (Mr. Kim) in a 'no punishment' resolution ... (The Appeals Court) We will alter the original Court Trial verdict, and collect $425 USD, and (choose punishment duration) as One Year and Eight Months in Prison (NO Probation)."

HWANG HANA was put on Court Trial in August last year (2020) for taking methamphetamine with her husband, the now suicide dead Mr. OH, and also with her other acquaintances, Mr. Nam and Mr. Kim. And with taking methamphetamine (illegal LSD) five times, including receiving and using methamphetamine with Mr. OH at a Seoul Motel (violation of the Law on Drug Management).

She (HWANG HANA) was also accused of stealing goods worth $425 USD from her acquaintance's (Mr. Kim) residence on November 29th last year (2020).

At the time of her indictment (current arrest), HWANG HANA was (already) serving a previous Court Probation Period. She was indicted on charges of injecting methamphetamine three times (LSD) at her home in May thru September 2015. And with using psychotropic drugs (illegal LSD) without prescription in April 2018, and was sentenced to One Year in Prison, converted instead to Two Years of Probation (NO Prison duration), and verified by an Appeals Court decision in November 2019.

Earlier in July (2021), the original Trial Court sentenced HWANG HANA, who was accused of taking illegal drugs again (LSD) during her Court Probation Period (Year 2019), to Two Years in Prison (NO Probation), and a fine of $350 USD. Since then, (both) the Prosecution and HWANG HANA have Court Appealed side by side. And, in an Appeals Court decision-making Hearing held in October (2021), the Prosecution demanded that HWANG HANA receive as punishment, a Two Years plus 6 Months Prison duration (increased), and a fine of $425 USD (increased).

HWANG HANA submitted (multiple) Letters of Apology to the Appeals Court Judge, 28 times in all, after her Appeal process began. She also admitted to taking (illegal LSD) drugs and appealed for leniency, unlike the original trial. Where she denied the charges of taking methamphetamine (LSD) by blaming her (now suicide dead) late husband, Mr. OH (for 'secret syringe needle injection' of the illegal LSD drugs into her body, while she was sleeping).

In a final court session (Oct. 2021) , she (HWANG HANA) said --> "I am ashamed that I was once again judged (in Court) for any reason ... I regret the years that I've missed (wasted as a drug addict) ... The last three or four years were insane (for me) because of sleeping pills and (illegal) drugs (addiction). Looking back on the past, I am strongly regretting it. It is shameful (behavior)."

HWANG HANA added, tearfully weeping (Oct. 2021) as --> "I hope you will find a reason to show mercy to me. Please help me return to my family, with kindness (to me). I didn't have the courage to deny it (my illegal LSD drugs addiction situation) in the original Court Trial. I am so sorry and ashamed (about myself, and to my family). My usage of sleeping pills, which (for me) were more a dependence than (illegal) drugs, was discontinued while being imprisoned (currently). I will stop [the misuse of drugs] application in any way (in the future)."

In response to the reduced Appeals Court punishment (by 4 months Prison duration), some (message posters) Internet Users observed that it is difficult to understand (the logic), saying as --> "(HWANG HANA) She did repeat usage of illegal drugs (LSD) during her previous Court Probation Period. But (somehow) receives a reduction in sentence (Prison duration punishment time) ???"

Meanwhile, HWANG HANA is a wealthy socialite, (public) known as the singer and actor (JYJ group) Park YOOCHUN's former lover. The two promised marriage together in Year 2017. But then suddenly delayed their marriage, and broke up as a couple in May of Year 2018.

(HH) HWANG HANA's Prison duration punishment was reduced by the Appeals Court from 24 Months to 20 Months ... Which , not much reduction ... But also , the Prosecutor was asking for 30 Months in Prison for her.

As added observation -->

(1) Ms. HH , in her original Court Trial , denied using illegal drugs (LSD) ... And *apparently* she and her now suicide dead husband , Mr. OH , had deceived Police via an elaborate but false story ... Such that Mr. OH stated to Police that HE had 'secretly syringe needle injected' the illegal LSD drug into HH , while she was asleep ... And HH did apparently stay with that explanation of her LSD drugs detection by Police , during the original Court Trial ... And her husband , Mr. OH , *apparently* became depressed at lying to Police , and subsequently committed suicide on 2020.12.24 date ... So , Mr. OH was obviously not available for original Trial Court testimony ... Ms. HH even did shave and/or color dye all her body hairs , in at attempt to have her illegal drugs *HAIR TEST* to not work properly (N.I.S.I Government Lab) ... The original Court Trial Judge stated that HH showed 'no remorse' during the original Court Trial.

(2) HH , in her Appeals Court Trial , changed her statement , and admitted to illegal LSD drugs usage. And also wrote numerous (24 in number) Letters of Apology to the Appeals Court Judge.

Conclusion -->

Ms. HH was fortunate to get a 4 Months reduction (to 20 Months of Prison punishment duration) in her situation ... Perhaps the Appeals Court Judge concluded that HH did truly regret all that has happened ... And HH is clearly an LSD illegal drugs addict ... So , NOT sure that PRISON duration punishment really solves the HH drug addiction problems very well ... Maybe the Appeals Court Judge sees it that way too , about HH ... Can NOT imagine that HH will adjust well to being a PRISON INMATE ... And with HH being wealthy and public known , I suspect that HH might be 'targeted' by other female INMATES for harassment and even money demands ... NOT a good situation (PRISON) overall for HWANG HANA ... Hopefully , she can survive it.

Why HWANG HANA received reduced Prison duration

in her Appeals Trial (Final Punishment) ; 2021.11.16

HWANG HANA (Age 33), who was convicted of illegal drug use (LSD), and was arrested for another (repeat) drug use (LSD) during the suspended sentence (Court Probation Period -- Year 2019), was commuted (reduced in Prison punishment duration) by the Appeals Court.

The Seoul Western District Court's Criminal Affairs Department 1-1 (The senior judge Sung Ji-ho) on the 15th overturned (modified) the original Court Trial ruling that sentenced HWANG HANA, who was indicted on charges of violating the Law on the Management of Narcotics, to Two Years in Prison, and (reduced) sentenced her to One Year and Eight Months in Prison (a 4 Month reduction).

The Court raised the surcharge from $350 USD to $425 USD.

HWANG HANA was put on Trial in August last year on charges of using illegal methamphetamine (LSD) with her husband Mr. OH (now suicide dead). And of using illegal drugs (LSD) with acquaintances Mr. Nam and Mr. Kim. And using the (LSD) methamphetamine five times (different date events), including receiving methamphetamine from Mr. OH at a Seoul Motel late the same month.

The Court (Judge) explained the reason for the sentence, saying, "The defendant admitted to some of the medication crimes. And the (theft) victim (Mr. Kim) submitted a non-punishment request letter after reaching agreement with HWANG HANA concerning the theft matter (crime).

However, regarding the charge of using methamphetamine (LSD), which was partially acquitted in the original Court Trial, the Appeals Court reversed that judgment, saying that "All (instances on LSD usage) are found Guilty."
