sentenced to PRISON for *ONE YEAR plus 6 MONTHS* ; 2021.11.15

*** HAN SEO HEE and her current Prison Punishment situation ***
On 2021.11.15 , (HSH) HAN SEO HEE was sentenced to *1.5 YEARS* in PRISON for using illegal drugs (LSD) during her Court Probation Period (*4 Years* duration , dating from Sept. 2017) ... HSH failed a monthly Urine Test in June of Year 2020 ... When usage of LSD drug (methamphetimine) was detected by Probation Office workers via the Urine Test for HSH ... The Urine Test for those on illegal drugs Court Probation is done once per month as standard practice ... At that time , HAN SEO HEE questioned the Urine Test process as being flawed ... And so , an illegal drugs *HAIR TEST* was ordered for HSH ... And the (very accurate , performed by N.I.S.I Government Lab) *HAIR TEST* returned as showing NO ILLEGAL DRUGS for HAN SEO HEE ... And HSH was released from the Holding Jail , after 20 days duration there ... And importantly , the HSH Court Probation Period agreement remained in place ... Meaning that HAN SEO HEE would NOT be in PRISON for up to *3 Years* duration ... Which was the Court specified punishment IF that HSH did violate her Court Probation Period situation by again using illegal drugs ... My view , is that the JUDGE involved at the time , decided to place *importance* on the *HAIR TEST* result as showing NO ILLEGAL DRUGS for HAN SEO HEE ... I honestly *doubt* that the JUDGE felt that there was an error in the Urine Testing process as conducted by the Probation Office Workers at that time (June 2020).
Probably too , the JUDGE (August 2020 = HSH release date) knew full well , that PROSECUTORS had the *option* to *RE-FILE* their Criminal Complaint on this failed Urine Test issue in the future , with regard to HAN SEO HEE ... In other words , PROSECUTORS can investigate HAN SEO HEE more , update their legal complaint , and try for a NEW *indictment* (Court Hearing event) of HAN SEO HEE , over that same failed (June 2020) Urine Test ... Which is exactly what PROSECUTORS did it in June 2021 ... So , my view , the JUDGE in June 2020 , simply went with the *HAIR TEST* result , and chose to maintain the HSH Court Probation situation ... And NOT have to say that HSH is guilty , and place her in PRISON at that time (Aug. 2020) for some significant duration of time ... Let the PROSECUTORS decide (future) IF they want to try to put HAN SEO HEE in PRISON *again* via another new Court Hearing with a *new* different Court JUDGE ... I can follow the logic of that JUDGE in August of Year 2020 ... Let the PROSECUTORS build a stronger case , IF they can do it , against HAN SEO HEE ... And have another Trial Hearing event with a different JUDGE ... The PROSECUTORS clearly had that option with HAN SEO HEE , and did eventually use it (new indictment of HSH).

HAN SEO HEE denies allegations of illeal drug usage (LSD)
in June Year 2020 , is *charged* for Trial event ; 2021.06.10
The first trial was held at the Seongnam Branch of the Suwon District Court on the afternoon of the 9th for the former singer trainee HAN SEO HEE, who was indicted without detention on charges of drug administration during her Court Probation Period (from Sept. 2017).
At the Trial, the Prosecution revealed the gist of the indictment , that HAN SEO HEE (used) administered methamphetamine (LSD) at a Buddhist statue in Gwangju in June last year (2020), but HAN SEO HEE denied this (in Court) ... (Meaning that future Trial Court and JUDGE activity is needed for decision)
HAN SEO HEE was previously charged with smoking marijuana, and in September 2017, she was sentenced to three years in prison , converted instead to four years of probation (no Prison duration).

So , this JUNE 10, 2021 *First Trial* event , was likely an opportunity for HAN SEO HEE to *choose* to do a GUILTY PLEA at that time ... In other words , when the PROSECUTOR and HAN SEO HEE show up in Court , it is known that HSH will agree to be GUILTY and accept JUDGE chosen punishment at that time ... Which , that PROSECUTOR requested ONE YEAR in PRISON as punishment at the time for HSH ... HAN SEO HEE could have said that she did not want to dispute with the PROSECUTOR ... That she would instead plead GUILTY ... And hoped that the JUDGE might choose LESS PRISON punishment duration than ONE YEAR in PRISON ... I would suggest that HSH mention her official N.I.S.I Lab *HAIR TEST* that showed NO ILLEGAL DRUGS in August of Year 2020 ... And also , HSH could say that the PROBATION PERIOD was long and stressful (beginning in Sept. 2017) ... And that she had failed herself (HSH) , her family , and the COURT , and deeply regreted that happening ... And that HSH is fearful of a long PRISON punishment (no doubt true) ... And HOPES that the JUDGE might decide on maybe *9 MONTHS* in PRISON as punishment ... Because the TRIAL activity for the PROSECUTOR and JUDGE , the TIME and EXPENSE of that , is avoided by the HAN SEO HEE guilty plea.
And it would seem that PROSECUTORS have some strong evidence in this HSH situation ... Because they are mentioning a *location* (Buddhist Statue) where HAN SEO HEE supposedly used the illegal LSD drug.
Instead , HAN SEO HEE chooses at that time (June 2021) to DISPUTE with the PROSECUTOR ... And there are then a series of CLOSED COURT EVENTS for HSH ... Where HSH apparently makes statements that question the work performance of the Probation Court Workers who do the Urine Testing ... Which , a JUDGE is NOT likely to be wanting to hear or believe that very much.
So , on November 17th , HAN SEO HEE was found GUILITY by the JUDGE ... Who stated as she believed the PROSECUTOR and the URINE TEST results showing illegal drugs usage for HSH ... And then , the JUDGE chose punishment of ONE YEAR *plus* 6 MONTHS as PRISON punishment ... So , *6 MONTHS MORE* in PRISON for HSH than the PROSECUTOR had asked for it (JUNE 2021) ... And apparently , HAN SEO HEE had NO IDEA that she would be ARRESTED and sent to PRISON immediately on November 17th ... And HAN SEO HEE became openly verbally angry about the situation , while in the COURT ROOM , where it was heard ... Which , this is NOT good at all either , for HAN SEO HEE.
HAN SEO HEE can now use the APPEALS COURT , to question her PRISON punishment duration ... BUT , she will be waiting say for *6 MONTHS* before her APPEALS COURT event finally is scheduled and active , and a decision gets made by an APPEALS JUDGE ... Which , there is NOT any promise that the HAN SEO HEE punishment of PRISON duration will be reduced either ... You could get an APPEALS COURT JUDGE who reasons as -->
"You , HAN SEO HEE , chose to WASTE the TIME and MONEY of the COURT ... By questioning the honesty of Probation Office Workers ... And then , you , HSH , were disrespectful to the JUDGE in the COURT ... Your previously Court specified Punishment for Court Probation Period violation (usage of illegal drugs again) , was set at *3 YEARS in PRISON* ... The PROSECUTOR wanted to give you *ONE YEAR* in PRISON ... But you , HSH , wanted to argue about it , and ended up with ONE YEAR *plus* 6 MONTHS as your punishment from the JUDGE ... So , now , HAN SEO HEE , as APPEALS COURT JUDGE , I am going ADD another *6 MONTHS* onto your 1.5 YEARS in PRISON, and make it instead *2 YEARS in PRISON* for you , HAN SEO HEE ... And good luck to you , HAN SEO HEE ... And this APPEALS COURT event is ended now."
And that would be perfectly legal for the APPEALS COURT JUDGE to do that ... After all , the *specified* amount of PRISON punishment for PROBATION violation by HSH , was *3 YEARS in PRISON* ... So , *2 YEARS in PRISON* , is *less* than *3 YEARS in PRISON* ... So the APPEALS JUDGE is still being 'generous' , in terms of NOT giving HSH the MAXIMUM specified PRISON Punishment of *3 YEARS in PRISON* ... Is a logic that might be argued.
In any event , I would use APPEALS COURT , if that I was HAN SEO HEE ... To TRY to get the PRISON punishment for HSH reduced to the *ONE YEAR of PRISON* that the PROSECUTOR initially wanted it for her ... And that HSH may very well have been able to have that (ONE YEAR of PRISON), IF she had done a GUILTY PLEA in June 2021 at her First Trial event ... But NOW , I am just NOT so clear on how an APPEALS COURT JUDGE is going to view HAN SEO HEE's request for LESS PRISON punishment ... It is just NOT a good situation at all , in my view ... And , does HAN SEO HEE have to admit GUILT that she actually did use LSD ??? ... And that she was using some fabricated story about her sample cup being in the toilet water ??? ... But , I would try to do an APPEALS COURT event , if I was HAN SEO HEE ... But it is NOT without danger for HSH either ... HSH might get ADDED *PRISON* punishment time , not reduced time ... That is an option for the APPEALS JUDGE , to *add* MORE punishment for HSH.
Personally , I think *9 MONTHS* in PRISON for (HSH) HAN SEO HEE is plenty enough punishment ... And it is physically dangerous for HSH to be around other INMATES ... As HSH is somewhat known as being wealthy (her family situation) ... You have the danger of possible *physical confrontation* between HSH and *other* INMATES ... And even a situation of HSH having possible problems with PRISON GUARDS ... Which , some 'inside the prison' bad event , could cause HAN SEO HEE to end up with even MORE PRISON duration time ... The whole PRISON situation is fairly terrible for HAN SEO HEE overall ... Hopefully , HSH survives it ... I am guessing that HAN SEO HEE will be fortunate to have an APPEALS JUDGE give her *ONE YEAR in PRISON* ... Again , NO IDEA what an APPEALS JUDGE might choose to do with regard to HAN SEO HEE.
