    According to the court, Kim Sang-gyun should pay 220M KRW and Takada Kenta 665M KRW to Star Road Ent. for damages that have been caused, the rest of the claims from Star Road Ent. are dismissed. Previously, Star Road Ent. filed a lawsuit against Kim Sang-gyun for 800M KRW and Takada Kenta for 1,7B KRW for damages.


    They claimed, "We don't accept their claim saying that we have failed to support their activities in the entertainment industry. The company's financial situation deteriorated in 2020 as an aftermath of COVID-19 pandemic. It's not because the company is not doing their job properly.


    The court explained, "Some lessons like acting class were stopped due to the company's financial situations, but those were not lessons that are necessary."


    The court also added, "Kim Sang-gyun and Takada Kenta are the ones who breached the exclusive contract. Instead of breaking the contract one-sidedly, they should've used their talent and skill to continue activities in the entertainment industry". In addition, the court said, "We think they were already given a clear explanation and advance notice about the online concert"


    On the issue of JBJ95's claim of unpaid wages and breach of an exclusive contract, the court explained, "After Star Road Ent.'s staff resigned, the CEO voluntarily replaced the place of JBJ95's manager and worked really hard to plan and organize for their online concerts. Therefore, JBJ95 is the one who is responsible for the breach of an exclusive contract"

  • So they were not getting any activities, the company wasn't providing them lessons, accommodation nor food, the boys had to pay for everything including new staff themselves, they sued, the company tried to organize a concert in the middle of the lawsuit but the boys did not participate and refused to attend, and the company managed to sue them and win for that, even though the boys were already suing the company for all of things previously mentioned? Make it make sense!

  • Korean artists should stop relying on companies so much if I constantly only hear so much BS and should all go indipendend with no company. I mean it works for example in Japan where many artists have no company so I don't see why other countries can't do that too, but than again compared to Japan Korean acts want more exposure and that is something you can't do indipendently if you start from zero with no income

    since to my knowledge the failure to attend online concerts does seem like a breach of contract purely because the two members did not obtain an injunction or relief from performing the contract notwithstanding the lawsuit...
