Hwang Ha-na sentenced to two years in prison ; 2021.07.09

Court: No remorse, persistent denial of crime (from Hwang Ha-na)

Hwang Ha-na (Age 33) was sentenced to Two Years in Prison (No Probation) for (illegal) drug administration (usage) and theft while on (Court) Probation.

Judge Lee Sun-mal of the Seoul Western District Court sentenced Hwang Ha-na to two years in prison and a fine of 400,000 KRW in the trial on the July 9, 2021.

In response to Hwang Ha-na's claim that she did not take methamphetamine, and that her hair and urine tests were negative (for illegal drugs), the Court said she was "found guilty", citing the positive detection of methamphetamine in four of the nine disposable syringes (needles), Hwang Ha-na's blood stain (detected), and two methamphetamine positive reactions, and Hwang Ha-na's DNA (detected), which were (all) evidence submitted by the Police.

In addition, the Judge said that (Hwang Ha-na's husband) Mr. Oh reversed his statements to the (Police) Investigative Agency, including (Oh retracting statements that) ... "I administered the methamphetamine alone." ... "Hwang Ha-na seems to have scratched me with a needle while trying to stop me (from giving her drugs)." ... And ... "I had done secret drug administration to Hwang Ha-na (unknown to her)" ... (This was wrongly stated previously by Mr. Oh to Police) ... Apparently because (Mr. Oh) he intended to protect the defendant (Hwang Ha-na, his wife).

Regarding Hwang Ha-na's claim that (her husband) Mr. Oh had secretly drugged her, and she did not know because she had no response to her body, the justice department said, "It is not convincing that (Hwang Ha-na) she did not know (of secret drugging) all four times," adding that no male DNA was detected in the syringe (needles). If Mr. Oh did 'secret drugging' (of Hwang Ha-na), (then) Mr. Oh's DNA should have been detected in the syringe," the Judge pointed out. (Also) Referring to Hwang Ha-na's full-length hair removal and dyeing before the urine and hair tests (for illegal drugs being present), the Court (Judge) also said, "She appears to have tried to interfere with the (illegal drugs) test (done by Police)."

Hwang Ha-na also pleaded guilty to the charges of theft, including luxury clothes, saying, "I thought Kim had a comprehensive and tacit intention, such as changing shoes for Kim, and I thought Kim had changed his shoes with Nam." In response, Hwang Ha-na said, "I said it was at Nam's request, but I gave him the money (to Kim at the Police Detention Center, after his arrest), but I didn't give him the jacket." ... (Note: This 'theft' translation result was a bit confusing).

Lastly, the Court (Judge) said, "(Hwang Ha-na) She committed the same kind of (illegal drugs) crime during the probation period," and revealed the reason for the (prison) sentence, saying, "From the (beginning) Police Investigative Agency (interaction) to this Court (Proceeding ending), (Hwang Ha-na) does not reflect on herself."

In a decision-making hearing last month, the Prosecution demanded a two-year and six-month prison term and a fine of 500,000 KRW, saying that "(Hwang Ha-na) the defendant committed the crime again even though she was given a suspended sentence. And then she tried to pass responsibility for her illegal drug behavior crimes over to her (now) deceased husband (Mr. Oh) without acknowledging her crimes."

Hwang Ha-na was arrested and charged for taking methamphetamine at her home in Seoul from May to September 2015. And was sentenced to One Year in Prison, (converted to) Two Years of Probation (No Jail Time), a 2.2 million KRW fine, Probation and drug treatment (rehabilitation) in the first trial in July 2019.

Hwang Ha-na was released (from Jail) after being sentenced to Probation. In November of that year, the first Trial (sentence punishment) was confirmed (validated), when her appeal was dismissed at a (Court) Appellate Trial.

However, Hwang Ha-na was re-arrested in January last year for stealing luxury clothes worth 5 million KRW from Mr. Kim's home. And she was also arrested, along with her (now suicide dead) late husband, Mr. Oh, his acquaintance Mr. Nam, and Mr. Kim, concerning several criminal charges involving taking methamphetamine (illegal drugs) from August to December last year during the (Hwang Ha-Na) Probation period. Mr. Nam, an accomplice who took drugs with Hwang Ha-na, fell into (hospitalized) critical condition after making an (suicide attempt) extreme choice on Dec. 17 of last year (2020). And her husband, Mr. Oh, ended his life on Dec. 24, a few days later.
