Yang Hyun Suk Sentenced To Probation Following Appeals Trial For Blackmail Charges

Yang Hyun Suk has been sentenced to one year of probation following his appeals trial for his blackmail charges.

The Seoul High Court held an appeal hearing for Yang Hyun Suk on November 8. Yang Hyun Suk was previously indicted for violating the Act on Aggravated Punishment for Specific Crimes, specifically for threats of retaliation and blackmail. Here, the court overturned the previously ruling that Yang Hyun Suk was to be acquitted of his charges. Instead, he was sentenced to one year of probation, with six months in prison should he violate probation.

Former YG Entertainment CEO Yang Hyun-suk, who was acquitted in the first trial of blackmailing an informant in an attempt to block a drug investigation of a YG singer, was found guilty in the second trial. He was given a six month suspended sentence with 1 year probation.(This means he will not serve any time) The Seoul High Court Criminal Division (comprised of three judge panel) handed down the verdict...Yang had been accused of threatening an informant in an attempt to undermine a drug investigation.

The first trial court acquitted Yang in December of 2022. The court found that the defendant did appear to use words to persuade or pressure the victim but that there wasn’t sufficient evidence to prove the defendant threatened the victim with specific and direct harm rather than merely persuasion or requests for a retraction (of a previously given statement). For the crime of retaliatory intimidation to be established, it must be proven that the victim's freedom of expression was suppressed due to fear, which the evidence did not show.

The appeals court found that the first trial court was correct in acquitting Yang on the threats of blackmail but decided that the crime of coercion was met and applied that charge in the appeal trial.
