what research? you can do as much research as one wants and still have incomplete information since not all information is released to the public
we don't have all the evidence we have information presented to the public by biased people who only release such information to benefit their side
hybe isn't going to release footage showing the manager badmouthing NJ
MHJ isn't going to release information showing her meeting with potential investors
every piece of information we've seen from both sides are released only to benefit their side
the question of whether that information becomes evidence is up to the court no? the weighting of the evidence - the credibility of the witnesses - the admissibility of the information etc etc is all beyond us as members of the general public
hell even lawyers don't present evidence per se no? they present information to the courts and it's up to the courts to determine whether such information is evidence or not no?
I've already said the law is not perfect however the systems that we have is the best it can be no? it is the implementation of said system that causes issues like you mentioned no? on the face of it it is suppose to the fair and all that but in practice it's not and thus I don't disagree with your position that (most things) are stacked in favour of those with the deepest pockets
if the law is the problem then the law needs to change - whether a society has the determination to change inequitable laws is another matter
